Welcome to Revira™. By accessing our website or purchasing from our store, you agree to be bound by the following terms and conditions. Please read them carefully before using our services.

1. Overview and Acceptance

This website is operated by Revira™ ("we," "our," "us"). Throughout the site, the terms "you" and "your" refer to the user, customer, or visitor. By visiting our site and/or purchasing a product from us, you engage in our "Service" and agree to be bound by these Terms of Service, which constitute a binding legal agreement.

These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and content contributors. If you do not agree to these Terms, you must immediately discontinue use of this website and our services.

2. General Conditions

We reserve the right to refuse service to anyone, for any reason not prohibited by law, at any time, in accordance with California Civil Code Section 51 et seq. and California's Unruh Civil Rights Act. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or access to the Service without express written permission by us. Violation of this provision may result in civil liability under California Civil Code Section 3344 and federal copyright law (17 U.S.C. § 101 et seq.).

You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, and that you possess the legal authority to enter into this agreement and use the Service in accordance with these Terms.

3. Product Availability and Pricing

All prices are subject to change without notice pursuant to California's common law principle that advertisements constitute invitations to bargain rather than binding offers. We reserve the right to modify or discontinue any product without prior notice. We are not liable for any price changes, product modifications, discontinuation, or delivery delays.

While we strive for accuracy, we are not responsible for typographical errors, inaccuracies, or omissions in product descriptions or pricing. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and provide you with the option to reorder at the correct price.

Pricing errors do not constitute binding offers under California Commercial Code Section 2204.

4. Shipping & Delivery

We ship to most regions globally. Delivery times are estimates only and are not guaranteed. Times vary by location and may be subject to unexpected delays due to customs processing, carrier issues, weather events, or force majeure events. Once an order has been tendered to a third-party carrier, risk of loss passes to you in accordance with California Commercial Code Section 2509.

You are responsible for entering complete and accurate shipping information. Orders with incorrect or incomplete addresses may result in delivery failure, return to sender, or delays, for which we are not liable. Any additional shipping charges incurred due to address corrections shall be borne solely by you.

We are not responsible for lost, stolen, or damaged packages once delivery confirmation has been provided by the carrier. You acknowledge that delivery to your specified address constitutes completion of our delivery obligation under California Commercial Code Section 2503.

5. Returns & Refunds

Please refer to our separate Returns Policy for eligibility criteria and procedures. We reserve the right to deny any refund requests that do not meet our stated guidelines.

Used, opened, damaged, or products showing signs of wear may not be eligible for return unless deemed defective upon original delivery. Customer is responsible for paying return shipping costs and covering all related customs duties, import fees, VAT, or FDA charges. All returns are subject to inspection and verification.

Refunds, when approved, will be issued to the original payment method within 30 days of our receipt and approval of the returned item. Shipping costs are non-refundable unless the return is due to our error or a defective product. Restocking fees of up to 20% may apply to certain returns.

The foregoing return policy complies with California Civil Code Section 1723 regarding disclosure of return policies.

6. Limitation of Liability and Disclaimers

6.1 Product Disclaimer

Our products are intended for general wellness use only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. These statements have not been evaluated by the Food and Drug Administration.

Consult your healthcare provider before using any light-based therapy device, especially if you have photosensitive conditions, epilepsy, are pregnant, are taking photosensitizing medications, or have any other health concerns.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, INCLUDING CALIFORNIA CIVIL CODE SECTION 1542, REVIRA™, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, punitive, exemplary, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage arising from your use of products
  • Any damages resulting from unauthorized access to or alteration of your transmissions or data
  • Any damages resulting from your reliance on product descriptions, representations, or marketing materials

This limitation applies regardless of the legal theory upon which such claim is based, including negligence, strict liability, breach of contract, or breach of warranty, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from your use of the Service or products shall not exceed the amount you paid for the specific product giving rise to the claim, or $100 USD, whichever is less.

6.3 Assumption of Risk

USE OF THE PRODUCT IS AT YOUR OWN RISK. You acknowledge and agree that you assume full responsibility for any risks associated with the use of our products. This assumption of risk is made knowingly and voluntarily in accordance with California Civil Code Section 1714.

6.4 AS-IS Provision

ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permissible under California law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement (California Commercial Code Sections 2314 and 2315).

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

7. Indemnification

You agree to indemnify, defend, and hold harmless Revira™, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, costs, claims, and demands, including reasonable attorneys' fees, due to or arising out of:

  • Your violation of these Terms of Service
  • Your violation of any law or the rights of a third party
  • Your use or misuse of the Service or products
  • Any content you submit or transmit through the Service

This indemnification obligation shall survive termination of these Terms and your use of the Service, in accordance with California Civil Code Section 2778.

8. Accuracy of Billing and Account Information

We reserve the right to refuse, cancel, or limit any order placed with us, including orders that appear to be placed by resellers, distributors, or dealers. In our sole discretion, we may limit quantities purchased per person, household, or order, which limitations may be enforced per credit card or billing address.

You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store. You agree to promptly update your account and payment information to ensure accuracy.

Fraudulent transactions may be reported to law enforcement authorities pursuant to California Penal Code Section 484e-484j (credit card fraud).

9. Intellectual Property Rights

All content on this site—including text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, and software—is the exclusive property of Revira™ or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws (17 U.S.C. § 101 et seq., 15 U.S.C. § 1051 et seq.).

Unauthorized reproduction, distribution, modification, public display, or creation of derivative works is strictly prohibited and may result in civil and criminal penalties under federal and California law, including California Penal Code Section 499c (unlawful access to computer data).

The Revira™ trademark and logo are registered marks. Nothing contained on this site should be construed as granting any license or right to use any trademark without our express written permission.

10. Arbitration and Dispute Resolution

10.1 Mandatory Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL BE RESOLVED THROUGH BINDING ARBITRATION rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration shall be conducted by a single arbitrator in accordance with the rules of JAMS (Judicial Arbitration and Mediation Services) or the American Arbitration Association (AAA), at our election. The arbitration shall take place in California, and California law shall apply.

10.2 Class Action Waiver

YOU AND REVIRA™ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. This waiver is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and California law.

10.3 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in California.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

12. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, in accordance with California Civil Code Section 1599.

13. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, pandemics, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. This provision is in accordance with California Civil Code Section 3513 (no one can take advantage of their own wrong).

15. Changes to Terms

We reserve the right to update, modify, or change any part of these Terms at any time by posting the updated Terms on this page with a new Effective Date. It is your responsibility to review this page periodically for changes. Your continued use of the website or Service following any updates constitutes your acceptance of those changes.

Material changes will be effective upon posting. If you do not agree to the modified terms, you must discontinue use of the Service immediately.

16. Entire Agreement

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Revira™ concerning your use of the Service and supersede all prior agreements, representations, warranties, and understandings with respect to the Service and the subject matter contained herein.

No amendment or modification to these Terms shall be binding unless made in writing and signed by an authorized representative of Revira™.

17. Survival

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
